A machine must demonstrably comply with the essential health and safety requirements of this regulation. Only then can—and may—you apply the mandatory CE marking to the machine.

Mandatory Requirement

Machines placed on the market within the EU must comply with the requirements set out in the Machinery Directive (in the future Machinery Regulation*) and related directives.

If a significant modification is made to an existing machine, this constitutes an infringement of the original CE marking. In such cases, a new CE procedure must be completed.

*From 20 January 2027, every machine must comply with the Machinery Regulation (EU) 2023/1230. Until that date, you have time to adjust processes, documentation, and the design of your machine(s). The Machinery Regulation is not yet mandatory but is already active.

Liability

Once you design, build, or sell a machine, you are responsible for ensuring that it complies with all essential health and safety requirements under the Machinery Regulation. Through an EU Declaration of Conformity, you declare that you presumably meet these requirements.

If you are ever held liable for injury caused by your machine, the accompanying technical documentation serves as the evidence demonstrating that you comply with the legal requirements.
